prAna vs. apana…are you confused?

The Plaintiff in this trademark lawsuit sells “sustainable clothing for yoga, travel, and outdoor adventure enthusiasts” using the PRANA word mark and logo. The PRANA trademark has been used since as early as 1992, and even this non-yogi is aware of the well-known brand.

The Defendants are accused of selling yoga apparel under the confusingly similar name “apana,” coupled with a logo that Plaintiff feels is confusingly similar to prAna’s distinctive logo design.

Of course, we’re dealing with yoga, so the Complaint was bound to get a little weird:

“Like “prana,” “apana” is also well-known to those who practice yoga, and is closely related as the balancing vayu to the prana-vayu. It is situated in the pelvic floor, and reflects energy that moves downwards and outwards.” “prana and apana are opposing, yet balanced forces. Where ‘prana’ regulates the intake of particles and energy, ‘apana’ is responsible for the elimination of the unabsorbed residues.” Assuming regular yoga folks know all this, wouldn’t that be an argument against confusion?

The plaintiff in this trademark lawsuit has been using the unregistered THERAPIA trademark for 7 years in connection with alternative medical services such as acupuncture, chiropractic therapy, massage, fertility consultation and treatment, and herbal medicine. Therapia operates in Portland, Oregon and promotes its services via its website, http://www.therapiaclinic.com.

The defendant, Therapydia Inc., is a national network of physical therapy and wellness clinics. Therapydia has locations in Portland, Beaverton, and Lake Oswego. Therapydia provides traditional (vs. alternative) medical services.

The Plaintiff first learned of Therapydia in mid-2016, and alleges instances of actual confusion beginning in January 2018, “with many patients calling Therapia to schedule appointments with Therapydia and consumers mistaking Therapydia advertisements for Therapia advertisements.”

Actual consumer confusion alleged in lawsuit over WESTCARE trademark

The plaintiff in this lawsuit, Westcare, is a Salem, Oregon-based provider of management services to long-term care facilities. Plaintiff claims to have used their “Westcare” mark since 1987. Plaintiff obtained a federal trademark registration in October 2017.

The defendant, Westcare Foundation, is a Nevada non-profit corporation that operates long-term and short-term care facilities, including a veterans’ facility in Salem, Oregon.

The defendant allegedly first began operating in Oregon in June 2012. Plaintiff became aware of the defendant’s Oregon facility in June 2016, and asserts numerous instances of actual consumer confusion.

Plaintiff sent a series of letters requesting that defendant adopt a DBA, with no success, hence this lawsuit. Stay tuned for updates.

On Electric sues OEG for trademark infringement, unfair competition

The plaintiff in this trademark lawsuit is an Oregon-based business “offering a full range of electrical services, including but not limited to residential, commercial and industrial services along with a comprehensive service department.” Plaintiff has used an ON ELECTRIC trademark since January 2015 in connection with its electrical services.

The defendant, OEG, allegedly began using an ON ELECTRIC trademark in connection with electrical services in August 2015. OEG apparently used to stand for “Oregon Electric Group” but it switched at some point to “On Electric Group.”

Both parties operate in Portland, Oregon and the surrounding areas. The complaint (below) alleges numerous instances of actual confusion among suppliers, advertisers, customers and others.

Portland, Oregon’s Heart coffee roasters has filed a Motion for Preliminary Injunction in its trademark lawsuit against nearby Heart Pizza (read the original Complaint here).

We also now have a Response from Heart Pizza. There’s some good legal reading in the documents (below) but I’ve included a few highlights. I especially like Heart Pizza’s arguments around why keeping its name is in the public interest.

Heart coffee v. Heart Pizza…are you confused?

This Portland-centric trademark lawsuit has some interesting facts. Normally a consumer might not confuse coffee roasters with pizza makers, but what about when they’re just one block apart?

Apparently the individual Defendant, a well-known Portland restaurateur and owner of Blue Star Donuts, used to be a daily visitor to Plaintiff’s Heart cafe on SW 12th Avenue. In addition to their coffee, he also seemingly liked their name, deciding to start an unrelated pizza shop called Heart Pizza just 0.1 miles away.

The Complaint (below) asserts actual confusion and alleges false representations of permission made by Defendant. Cease-and-desist communications from Plaintiff were unsuccessful, hence this lawsuit.

Both parties in this trademark lawsuit recently began using their respective trademarks (ROAMBUILT v. ROAM). ROAMBUILT is used in connection with “automotive parts,” primarily custom parts for Mercedes Benz Sprinter vans. ROAM is being used in connection with vehicle rental services and automobile customization services.

The parties corresponded for several months regarding the possibility of infringement and trademark coexistence. Unable to resolve the situation themselves, Plaintiff Roambuilt now seeks court intervention as they assert slight priority rights.

Since 2013, Plaintiff has operated a Portland vape shop/lounge on West Burnside Street called Vape Spot.

In August 2016, Plaintiff became aware that Defendant had opened a VapeSpot on SE Division Street. Daily instances of confusion and an unsolicited call from Captain Amsterdam regarding Kratom – a product apparently being investigated by the FDA -led to this trademark lawsuit.

Since 2008, Plaintiff has produced a line of dairy alternative beverages (for use with coffee, tea, etc.) under the BARISTA SERIES trademark.

Defendant distributes a similar non-dairy alternative under the trademark BARISTA BLEND. However, Plaintiff noticed in 2015 that Defendant’s product also bore the BARISTA SERIES trademark (see Exhibit B).

Apparently unable to resolve their dispute over the last year, this lawsuit seeks damages and an injunction against Defendant’s use of BARISTA SERIES.
