Dr. Seuss Enterprises accused by author of stealing Daisy-Head Mayzie

This rather lengthy, interesting, and unorthodox copyright complaint, filed by a pro se author, accuses Dr. Seuss Enterprises of stealing the character “Daisy-Head Mayzie” from his children’s story, “The Pains of Being Pure at Heart.”

Daisy-Head Mayzie is about a girl who suddenly sprouts a daisy from her head. Plaintiff’s story is about Lukus Loo, a boy(?) seemingly missing the top of his head, sometimes covering it with a crown, sometimes with three flowers. You be the judge after reading the Complaint (below). The Plaintiff’s itemized list of “plagiarized elements” begins on page 31 of the Complaint.

The Plaintiff has a long history with the Seuss estate, including several prior lawsuits, including most recently the Federal Court of Canada, which dismissed its suit on jurisdictional grounds in April 2017. The prior history, at least the Plaintiff’s side, is set forth in detail in the Complaint. The Dr. Seuss estate even had the Plaintiff arrested for extortion in 2003.

Since 2008, Plaintiff has produced a line of dairy alternative beverages (for use with coffee, tea, etc.) under the BARISTA SERIES trademark.

Defendant distributes a similar non-dairy alternative under the trademark BARISTA BLEND. However, Plaintiff noticed in 2015 that Defendant’s product also bore the BARISTA SERIES trademark (see Exhibit B).

Apparently unable to resolve their dispute over the last year, this lawsuit seeks damages and an injunction against Defendant’s use of BARISTA SERIES.

The Plaintiff in this action, Highbrow, LLC, seeks a declaratory judgment that its use of the “HIGHBROW” trademark in connection with an online beauty website does not infringe or otherwise violate the rights of Defendant Highbrow Magazine, LLC.

Highbrow Magazine is a “politically liberal, general-interest magazine covering News & Politics, Media, Arts & Entertainment, Food, and Travel.”

According to the Complaint (below), Highbrow was threatened with litigation by Highbrow Magazine and thus preemptively filed this declaratory action in Oregon. A series of discussions over a non-litigious resolution were unsuccessful.

There is some interesting language in the final demand letter from Highbrow Magazine (see Exhibit 5) that arguably forced the hand of Highbrow:

Note that we have also sent this letter to your domain registrar and Web hosting company, which means that they may be liable for contributory infringement for any continuing trademark infringement subsequent to receipt of this notice.

By bringing the registrar and web host into the situation, Highbrow was left with really no other option but to seek a court’s declaration of non-infringement. Better in Oregon than New York for many reasons for the Portland-based Highbrow.
