File Date: Tuesday, February 21, 2012
Plaintiff: Metal-Tech Cage, LLC
Plaintiff Counsel: Kevin M. Hayes of Klarquist Sparkman LLP
Defendant: Jason DeMello, DeMello Offroad
Cause: Trademark Infringement, Unfair Competition
Court: District of Oregon
Judge: Magistrate Judge Janice M. Stewart
This is a lame suit. The products are made with different size material and MT is not the first company to make this design..
IMO Demello did a nicer job and MT is jealous of Demello’s product… I will never give a penny to MT
Dave O, you clearly do not know intellectual property law. In reviewing this complaint it is over a Trademark. Material size unless part of the original Trademark, will have limited value to the Defendants response. The Plaintiff Metal-tech Cage, LLC does have a valid published Trademark and the right to defend it. In reviewing the complaint and the Trademark, the Defendant would be wise to seek a settlement.
